Illinois Has a Survival Statute
Under Illinois law, a lawsuit in progress may be transferred to the surviving spouse or family members to continue the suit if the plaintiff dies. In that case, the suit for injury compensation will continue, and significant damages may be awarded to the family in a settlement or jury verdict.
